This includes, in particular, the Federal Data Protection Act (Bundesdatenschutzgesetz – BDSG). The BDSG contains specific provisions regarding the right to information, the right to erasure, the right to object, the processing of special categories of personal data, processing for other purposes, and transfer and automated individual decision-making, including profiling. Furthermore, the data protection laws of the individual federal states may apply.</p&3e;
<p><strong>Note on the applicability of GDPR and Swiss FADP: </strong>These privacy notices serve to provide information both according to the Swiss FADP and the General Data Protection Regulation (GDPR). For this reason, please note that due to the broader spatial application and comprehensibility, the terms of the GDPR are used. In particular, instead of the terms "processing" of "personal data", "overriding interest" and "particularly sensitive personal data" used in the Swiss FADP, the terms "processing" of "personal data", as well as "legitimate interest" and "special categories of data" used in the GDPR are used. However, the legal meaning of the terms will continue to be determined by the Swiss FADP within the scope of its applicability.</p>
<p><strong>Applicability of data protection regulations in the country of establishment: </strong>In the country where the controller is established, national data protection regulations apply in addition to the General Data Protection Regulation (GDPR).</p>
<h2 id="m27">Security measures</h2><p>In accordance with legal requirements, and taking into account the state of the art, implementation costs, the nature, scope, context and purposes of processing as well as the varying likelihood and severity of the risk to the rights and freedoms of natural persons, we implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk.</p>
<p>Measures include, in particular, safeguarding the confidentiality, integrity and availability of data by controlling physical and electronic access to the data, as well as access, input, transfer, ensuring availability and their separation. Furthermore, we have established procedures that ensure the exercise of data subjects' rights, the deletion of data, and responses to data breaches. We also consider the protection of personal data during the development or selection of hardware, software, and procedures, in accordance with the principle of data protection by design and by default.</p>
<p>Securing online connections with TLS/SSL encryption technology (HTTPS): To protect user data transmitted via our online services from unauthorized access, we use TLS/SSL encryption technology. Secure Sockets Layer (SSL) and Transport Layer Security (TLS) are the cornerstones of secure data transmission on the internet. These technologies encrypt the information transmitted between the website or app and the user's browser (or between two servers), thereby protecting the data from unauthorized access. TLS, as the more advanced and secure version of SSL, ensures that all data transmissions comply with the highest security standards. When a website is secured with an SSL/TLS certificate, this is indicated by HTTPS in the URL. This serves as an indicator to users that their data is being transmitted securely and encrypted.</p>
<h2 id="m25">Transfer of personal data</h2><p>In the course of our processing of personal data, it may happen that they are transferred to other bodies, companies, legally independent organizational units or persons, or disclosed to them. Recipients of this data may include, for example, service providers commissioned with IT tasks or providers of services and content that are integrated into a website. In such cases, we comply with legal requirements and, in particular, conclude appropriate contracts or agreements with the recipients of your data that serve to protect your data.</p>
<h2 id="m24">International data transfers</h2><p>Data processing in third countries: If we transfer data to a third country (i.e., outside the European Union (EU) or the European Economic Area (EEA)) or if this happens in the context of using third-party services or disclosing or transferring data to other persons, bodies or companies (which is recognizable by the postal address of the respective provider or if the privacy policy expressly refers to data transfer to third countries), this is always done in accordance with legal requirements.</p>
<p>For data transfers to the USA, we primarily rely on the Data Privacy Framework (DPF), which was recognized as a secure legal framework by an adequacy decision of the EU Commission dated July 10, 2023. In addition, we have concluded standard contractual clauses with the respective providers that comply with the requirements of the EU Commission and establish contractual obligations for the protection of your data.</p>
<p>This double safeguard ensures comprehensive protection of your data: The DPF forms the primary level of protection, while the standard contractual clauses serve as additional security. Should there be changes within the DPF, the standard contractual clauses will act as a reliable fallback option. This ensures that your data remains adequately protected even in the event of any political or legal changes.</p>
<p>For individual service providers, we will inform you whether they are certified under the DPF and whether standard contractual clauses are in place. <p>For data transfers to other third countries, corresponding security measures apply, in particular standard contractual clauses, explicit consents, or legally required transfers. <h2 id="m12">General information on data storage and deletion</h2><p>We delete personal data that we process in accordance with legal provisions as soon as the underlying consents are revoked or there are no further legal bases for processing. This applies to cases where the original processing purpose ceases or the data is no longer required. Exceptions to this rule exist if legal obligations or special interests require longer retention or archiving of the data.</p>
<p>In particular, data that must be retained for commercial or tax reasons, or whose storage is necessary for legal prosecution or to protect the rights of other natural or legal persons, must be archived accordingly.</p>
<p>Our privacy notices contain additional information on the retention and deletion of data that applies specifically to certain processing processes.</p>
<p>If there are multiple specifications for the retention period or deletion deadlines for data, the longest period is always decisive. Data that is no longer used for the originally intended purpose, but is retained due to legal requirements or other reasons, will be processed by us exclusively for the reasons justifying its retention.</p>
<p>Retention and deletion of data: The following general periods apply to retention and archiving under German law:</p><ul> <li>10 years - Retention period for books and records, annual financial statements, inventories, management reports, opening balance sheets, and the work instructions and other organizational documents required for their understanding (§ 147 para. 1 no. 1 in conjunction with para. 3 AO, § 14b para. 1 UStG, § 257 para. 1 no. 1 in conjunction with para. 4 HGB).</li><li>8 years - Accounting vouchers, such as invoices and expense receipts (§ 147 para. 1 no. 4 and 4a in conjunction with para. 3 sentence 1 AO and § 257 para. 1 no. 4 in conjunction with para. 4 HGB).</li><li>6 years - Other business documents: received commercial or business letters, reproductions of dispatched commercial or business letters, other documents insofar as they are relevant for taxation, e.g., hourly wage slips, cost accounting sheets, calculation documents, price markings, but also payroll documents, insofar as they are not already accounting vouchers and cash register receipts (§ 147 para. 1 no. 2, 3, 5 in conjunction with para. 3 AO, § 257 para. 1 no. 2 and 3 in conjunction with para. 4 HGB).</li><li>3 years - Data required to consider potential warranty and compensation claims or similar contractual claims and rights, as well as to process related inquiries, based on previous business experience and usual industry practices, will be stored for the duration of the regular statutory limitation period of three years (§§ 195, 199 BGB).</li> </ul>
<p>Start of period at the end of the year: If a period does not explicitly begin on a specific date and is at least one year, it automatically starts at the end of the calendar year in which the event triggering the period occurred. In the case of ongoing contractual relationships in which data is stored, the event triggering the period is the time the termination or other termination of the legal relationship becomes effective.</p>
<h2 id="m10">Rights of Data Subjects</h2><p>Rights of data subjects under the GDPR: As a data subject, you have various rights under the GDPR, particularly those arising from Articles 15 to 21 of the GDPR:</p><ul><li><strong>Right to object: You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Article 6(1)(e) or (f) of the GDPR, including profiling based on those provisions. Where personal data concerning you are processed for direct marketing purposes, you shall have the right to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing.</strong></li><li><strong>Right to withdraw consent:</strong> You have the right to withdraw given consent at any time.</li><li><strong>Right of access:</strong> You have the right to obtain confirmation as to whether or not data concerning you are being processed, and to obtain information about these data as well as further information and a copy of the data in accordance with legal requirements.</li><li><strong>Right to rectification:</strong> In accordance with legal requirements, you have the right to request the completion of data concerning you or the rectification of inaccurate data concerning you.</li><li><strong>Right to erasure and restriction of processing:</strong> In accordance with legal requirements, you have the right to request that data concerning you be erased without undue delay, or, alternatively, to request a restriction of the processing of the data in accordance with legal requirements.</li><li><strong>Right to data portability:</strong> You have the right to receive data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format in accordance with legal requirements, or to request their transmission to another controller.</li><li><strong>Right to lodge a complaint with a supervisory authority:</strong> Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, if you consider that the processing of personal data relating to you infringes the provisions of the GDPR.</li></ul>
<h2 id="m317">Business Services</h2><p>We process personal data of our contractual and business partners, such as customers, clients, prospective customers, suppliers and other cooperation partners (collectively "contractual partners"), for the initiation, execution and processing of contractual relationships and similar legal relationships. This also includes pre-contractual measures taken upon request, as well as communication in connection with the respective contractual relationship.</p>
<p>The processing serves in particular to fulfill our primary and secondary contractual obligations. This includes the provision of agreed services, any updating and information obligations, the processing of warranty and other service disruptions, the handling of cancellations, terminations of continuing obligations, reversals, refunds, and the processing of other contract-related declarations and inquiries. Both one-off contracts and ongoing contractual relationships are covered.</p>
<p>In particular, master data such as name, address and, if applicable, company, contact data such as email address and telephone number, contract and service data such as contract subject, contract duration, order or transaction number, usage and performance data, payment and billing data as well as communication content and histories are processed. Where necessary, we also process data that is disclosed or transmitted to us in the course of carrying out an order.</p>
<p>In addition, we process the data to protect our rights and to fulfill legal obligations. This includes, in particular, commercial and tax law retention obligations, documentation obligations and, if applicable, proof and accountability obligations. Furthermore, processing is carried out on the basis of our legitimate interests in proper business management, internal administration, risk control and IT security, as well as in the protection of our business operations and our contractual partners from misuse, endangerment of data, secrets and other legal assets. This may also include the involvement of external service providers such as IT and telecommunications providers, transport and logistics companies, payment service providers, banks, tax and legal advisors or other vicarious agents, insofar as this is necessary for the execution of the contract or to fulfill legal obligations.</p>
<p>Personal data is only passed on to third parties if this is necessary for the fulfillment of the contract, for the implementation of pre-contractual measures, for the protection of legitimate interests or for the fulfillment of legal obligations. We will inform you separately about further processing, especially for marketing purposes, within the scope of this privacy policy.</p>
<p>We inform contractual partners about which data is required in individual cases as part of the data collection, for example in online forms by appropriate marking or in personal contact.</p>
<p>The data will be deleted as soon as they are no longer required for the aforementioned purposes and no legal retention obligations prevent deletion. Legal retention periods, in particular under commercial and tax law, may require longer storage. Data transmitted in the context of a specific order will be deleted by us after completion of the order and expiry of any retention periods, unless there are further legal or contractual obligations to store the data.</p>
<p>The legal basis for the processing is Art. 6 para. 1 lit. b GDPR for the implementation of pre-contractual measures and for the fulfillment of the respective contractual relationship, and Art. 6 para. 1 lit. c GDPR for the fulfillment of legal obligations. Insofar as the processing is based on legitimate interests, it is carried out on the basis of Art. 6 para. 1 lit. f GDPR. Insofar as the processing is based on Art. 6 para. 1 lit. f GDPR, it is carried out to protect our legitimate interests in proper and efficient business organization, internal administration and documentation of business processes, enforcement and defense of legal claims, ensuring IT and data security, preventing misuse and fraud, and the economic management and development of our business operations. <h2 id="m326">Payment Procedures</h2><p>Within the scope of contractual and other legal relationships, due to legal obligations or otherwise on the basis of our legitimate interests, we offer affected persons efficient and secure payment options and use other service providers in addition to banks and credit institutions for this purpose (collectively "payment service providers"). Payment transactions are carried out exclusively via encrypted connections according to the state of the art, so that the entered data is protected from unauthorized access during transmission.</p>
<p>The data processed by the payment service providers includes inventory data, such as name and address, bank data, such as account numbers or credit card numbers, passwords, TANs and checksums, as well as contract, sum and recipient-related information. This information is required to carry out the transactions. However, the entered data is only processed by the payment service providers and stored by them. This means that we do not receive any account or credit card-related information, but only information with confirmation or negative notification of the payment. Under certain circumstances, the data may be transmitted by the payment service providers to credit agencies. This transmission is intended for identity and credit checks. <h2 id="m225">Provision of the Online Offering and Web Hosting</h2><p>We process user data to enable them to access our online services. For this purpose, we process the user's IP address, which is necessary to transmit the content and functions of our online services to the user's browser or end device.</p>
